IRS Appeals
The IRS recognizes that it is not always correct. If you disagree with a decision made by the IRS, then you usually have the right to file an administrative appeal. A hearing will be conducted, in person, or over the phone, with an impartial hearing officer. Frank Tax Law informs you of your rights as a taxpayer and handles the appeals process with you and for you. In some cases, we meet with an IRS appeals manager and argue your case. Sometimes, the case may be transferred to a different IRS office where your chances for a favorable adjudication are improved.
We also assist in compiling and organizing forms of evidence that the taxpayer must present. In Appeals, the IRS is generally more inclined to settle cases and, moreover, the government is generally willing to make significant concessions to achieve a settlement. Given the enforcement minded attitude prevalent in the examination and collection divisions, revenue agents and revenue officers are stricter about records, proof of deductions, and OIC determinations. Conversely, Appeals Officers have broader discretion and are more willing to accept more creative arguments and forms of evidence.
